Staff Analysis of the Legislation

SB 167 moves to amend Code Section 15-11-211 of the O.C.G.A to restructure the legal management of children placed within the care of the state. Under this legislation if a court was unable to find relatives or fictive kin to take over care for the child, the court could allow the child to remain in foster care. This decision would be contingent upon both the child’s wishes and safety considerations about the home of said child.
